The undersigned ............................................................, with address: .........................................................., hereby declare that I give my consent to the Insurance Broker LEX INS Ltd. to process my personal data for the purpose of conclusion and performance of obligations under an insurance contract.

INSURANCE BROKER LEX INS Ltd. hereby provides information about your personal data that may be processed in connection with the conclusion and performance of obligations under an insurance contract.

What personal data do we process?

The personal data that is usually processed in connection with the conclusion and performance of obligations under an insurance contract are as follows:

- Name: first name, surname and family name;

- PERSONAL IDENTIFICATION NUMBER;

- Contact details: e-mail, address and telephone;

- Address: permanent or current;

- Bank information: bank account number;

- Information about the subject of the insurance contract - information about work experience, professional experience, ownership, etc;

- Health data: information about your health condition (diagnosis, epicrises, other health documents) provided for the purpose of submitting a proposal made for you, taking out insurance and making a claim.

On what basis do we process your personal data?

The processing of your data is necessary for the conclusion and performance of an insurance contract to which you are a party.

LEX INS INSURANCE BROKER Ltd may process your health data provided for the purpose of proving an insurance claim, establishing, exercising or defending legal claims. LEX INS INSURANCE BROKER Ltd. may process your health data for the purpose of preparing a proposal for an insurance contract on the basis of your explicit consent.

In certain cases, we share your data with service providers (experts and subcontractors) on the basis of the legitimate interest of LEX INS INSURANCE BROKER Ltd. to fulfil its obligations as an insurer and to improve the quality of the services provided. 

For what purposes will we use your data?

The personal data you provide will be used for the purposes of administering the insurance relationship, including but not limited to:

- preparing an individual insurance proposal;

- payment of the insurance premium;

- processing of claims in connection with the occurrence of an insured event and payment of an insurance indemnity in the event of a claim;

- prevention of insurance fraud;

- risk assessment;

- compliance with legislative requirements, including avoidance of conflicts of interest, corrupt practices and obligations under the Anti-Money Laundering Act

Profiling:

Please be aware that your personal data may be subject to profiling by information processing systems when preparing your quote for a particular insurance policy. Depending on the specifics of the particular type of insurance, LEX INS INSURANCE BROKER Ltd may use information systems to calculate the likelihood of an insured event occurring. The information systems work on the basis of set criteria developed by expert actuaries.

Your personal data is profiled on the basis of the legitimate interest of INSURANCE BROKER LEX INS Ltd. to assess the risk and assume contractual obligations based on the risk assessment. You may object to the profiling of your personal data. More information about the terms and conditions under which you can object can be obtained specifically from our employees, at the office of LEX INS INSURANCE BROKER LEX Ltd.

Who can we share your personal data with?

INSURANCE BROKER LEX INS Ltd respects and protects the confidentiality of your personal data. Subject to legal requirements, it is possible to disclose your personal data to the following persons:

■ Service providers (consultants, experts, appraisers, lawyers). When we use services related to the conclusion of the insurance contract and payment of the insurance indemnity, technical support of information systems and operational support of our business, it is possible that Lex Insurance Broker Ltd may disclose personal data. Such disclosures will only be made if there is a valid reason to do so and on the basis of a written agreement between the recipients to provide an adequate level of protection;

■ In the performance of its obligations under certain insurances, INSURANCE BROKER LEX INS Ltd. may disclose your data to subcontractors who provide services on behalf of INSURANCE BROKER LEX INS Ltd. outside the territory of the Republic of Bulgaria;

■ Insurers: In performance of its obligation under an insurance contract, INSURANCE BROKER LEX INS Ltd. may disclose your personal data to insurers, reinsurers, other insurance brokers and their representatives;

For how long do we keep your personal data?

INSURANCE BROKER LEX INS Ltd. keeps the individual documents it administers for the purpose of fulfilling obligations under insurance contracts and claims for payment of compensation as follows:

- Insurance contracts and documents which are an essential part thereof (proposal for conclusion of an insurance contract, policy, annexes, etc.) - maximum period of 10 years from the date of conclusion of the insurance contract, the period depending on the type of insurance;

- Documents relating to the application for an insurance claim - maximum period of 10 years from the date of the claim, depending on the type of insurance.

Your rights regarding your personal data:

Subject to Bulgarian law, you have the following rights in relation to your personal data processed by INSURANCE BROKER LEX INS Ltd:

1. to have access to your personal data processed by INSURANCE BROKER LEX INS LTD and to obtain a copy of it;

2. in the event of incompleteness or inaccuracy of the data that INSURANCE BROKER LEX INS Ltd. processes, your personal data may be corrected;

3. to request that your data be deleted when the prerequisites for this are met. Such cases are if: the purpose for which the data was collected has been achieved; you have withdrawn your consent where the processing is based on consent and there is no other lawful basis for processing; your data is being processed unlawfully, etc;

4. in the cases specified by law, to request that the processing of your personal data be restricted;

5. where your data is processed on the basis of a legitimate interest (listed above in this notice), you may object to the processing of your personal data on that basis;

6. exercise your right to data portability and request that your data be provided in a structured, commonly used and machine-readable format;

7. withdraw the consent you have given where the processing of your personal data is based on consent.

You also have the right to lodge a complaint with the Personal Data Protection Commission when the relevant prerequisites for this are present.
